Legal Notice
Risk Disclosure and Disclaimer
Last updated: 2026-07-28
This notice explains the respective roles of LarkSim, giffgaff, roaming networks, and third-party platforms when you purchase and use a giffgaff SIM. Please read it before ordering, with particular attention to operator account reviews, suspension, verification-code compatibility, and the irreversible effects of activation. Nothing in this notice excludes or restricts statutory rights relating to product quality, returns, remedies, or dispute resolution.
1. Roles and Service Boundaries
- LarkSim is an independent SIM-card seller and Chinese-language guide provider. It is not an official site, agent, or affiliate of giffgaff, Virgin Media O2, Telefónica, Codex, OpenAI, X, Claude, or any other third-party platform.
- LarkSim is responsible for supplying goods that conform to the order and for the dispatch, guides, and after-sales assistance expressly included in the order.
- The number, mobile service, account reviews, plans, top-ups, roaming, and service suspension or restoration are controlled by giffgaff or its network partners. Whether a third-party platform accepts a number, sends a code, or maintains an account is decided independently by that platform.
2. Key Risks You Must Understand Before Ordering
- Operator review and suspension: giffgaff may restrict, suspend, or terminate an account or SIM because of security checks, unusual usage, suspected fraud or spam, payment disputes, inaccurate details, or breaches of its terms or acceptable-use rules. Restrictions may occur without a separate notice, and giffgaff controls the outcome and restoration time.
- Third-party platform risk: a genuine UK mobile number does not guarantee that any platform will accept the number, send or deliver a verification code, approve an account, or keep an account available permanently.
- Roaming and network risk: roaming availability, coverage, SMS routing, charges, and partner networks in China or other non-UK locations may change and may experience temporary interruption, delay, or feature restrictions.
- Irreversible activation: a physical SIM contains unique activation information. Activation, number binding, or trial use creates irreversible records and substantially reduces resale value. After prominent notice on the mandatory checkout path and your affirmative confirmation, a physical SIM is not eligible for a seven-day no-reason return. Product-quality and other statutory rights remain unaffected.
- Non-refundable voucher risk: a voucher order enters code allocation and digital fulfilment as soon as payment succeeds. Except where we ultimately cannot fulfil the order, a duplicate charge occurs, the code was already invalid or used at delivery, the amount or product does not match, or applicable law requires a remedy, the order cannot be cancelled, returned without reason, exchanged for cash, or refunded, even if the code has not been viewed, claimed, or redeemed. Code issues are primarily remedied by re-delivery or replacement with a valid equivalent code.
- Policy changes: giffgaff, roaming partners, and third-party platforms may change their terms, fraud controls, pricing, supported number ranges, and technical rules. LarkSim cannot control future policies.
3. Your Use and Account Responsibilities
- Use an accurate identity and an email address you control long term to register, activate, and manage the account, and keep those details accurate.
- Use the SIM only for your own lawful, normal communications and account verification. Do not perform bulk registrations, automate code requests, send spam, resell accounts, evade platform restrictions, share payment instruments, or engage in activity likely to be treated as abnormal.
- Follow giffgaff's terms, fair/acceptable-use policies, and the rules of each target platform. Keep passwords, verification codes, vouchers, and devices secure.
- If service is restricted, stop repeated or high-frequency attempts, preserve notices and emails, and request a review through giffgaff's official support channel first.
- No refund is provided for product damage, suspension, account restriction, voucher loss, or other loss caused by bending, cutting, water damage, incorrect insertion, credential disclosure, unlawful or abnormal use, or other customer misuse. This does not apply where evidence establishes a pre-existing product defect or our fulfilment responsibility.
4. How Suspensions and Verification Problems Are Assessed
An account restriction, SIM suspension, or failure to receive a code from one platform does not constitute a SIM-card defect and is not eligible for a full refund by itself. This notice does not exclude responsibility where evidence shows a product defect, fulfilment error, or breach by us.
- First determine whether the physical SIM is detected by the device, registers on a mobile network, and can send or receive ordinary SMS.
- Then check the giffgaff dashboard, payment status, restriction message, and any official support response.
- If ordinary communications work and only one third-party platform fails, the issue will generally be assessed as a third-party compatibility or platform-risk-control issue.
- If the SIM was already invalid or bound to another person at delivery, has a manufacturing defect, or does not match the order, the Refund Policy and applicable law apply.
5. Scope of Assurance and Liability
- We do not promise permanent freedom from suspension, compatibility with every platform, guaranteed code delivery, or uninterrupted roaming in China unless the order page contains a specific written promise.
- To the extent permitted by law, we are not responsible for indirect loss, loss of business opportunity, third-party subscription loss, or data loss caused by third-party account action, the customer's unlawful or abnormal use, device or network conditions, or unforeseeable operator-policy changes.
- These limitations do not apply to loss caused by our intent or gross negligence, personal injury, or statutory claims involving product quality, misleading statements, fraud, or other non-excludable rights.
6. New and Existing Orders
- Orders placed on or after 28 July 2026 are governed by the version separately acknowledged and recorded at checkout.
- Earlier orders remain governed by the agreement in force when they were placed and by mandatory law. This notice may guide troubleshooting and after-sales handling but does not retrospectively reduce existing rights.
- Later versions generally apply only to orders placed after their effective date. Where a change is legally required, we will give a prominent notice and will not use publication alone to retrospectively exclude existing liability.
7. Official Information and Contact
Before use, read the official giffgaff Terms and Conditions. If an account is restricted, see giffgaff's official disabled-account guidance.
LarkSim support: support@larksim.com. We will never ask for your giffgaff password, email password, or SMS verification code.
